Full disclosure — I am now the official legal counsel for both Jennifer Jones and for Ed Foster, the Mayor of Quartzsite, Arizona, regarding all of the many well documented abuses of their civil rights, and in particular, their First Amendment protected rights of free speech, assembly, as well as their rights to take part in the political process, by the Quartzsite Chief of Police and Town Council.  This is in my individual capacity as a lawyer, not as the President of Oath Keepers.  I want to make that clear.  But I do see this as part of my responsibility to keep my oath, and in particular the oath I swore as a lawyer, to defend the Constitution.   Sometimes the law can indeed be used as a sword of justice, so please wish me luck in helping them hold the town council and the Chief of Police accountable!

    Interestingly, Mr. Rhodes is not licensed to practice in the State of Arizona. I will admit I am not a lawyer, but it doesn’t look right. Also, I only see the anti-Quartzsite peoples’ side here and their letters. How about waiting for the actual results of the Investigations on the Chief before hanging him up? I thought a lawyer (above) would certainly see that. Did he, Mr. Rhodes, see the (AZ) DPS report from 2010 whereby ‘Mayor’ Foster (along with a recalled former Councilperson and a certain policeman) made his 1st complaint against the Police Chief and the findings were: “The investigation has been completed and no criminal violations were discovered.” Later in the same document: “Based on our review of the additional criminal investigation would be futile due to a lack of criminal predicate, evidence, and/or witnesses.” (Direct quotes from the Arizona Department of Public Safety Document, dated June 23, 2010)

    Mr. Rhodes is claiming to counsel these 2 dissidents who have many, many counts, many not even relating to these Council Meetings, such as running businesses without licenses, impeding police business, not paying for court costs/fees when applied to plaintiff(s) for not succeeding in his/her lawsuit(s), etc. which are frivolous litigations (IMHO) just to spend more of the Town’s money.
    And when an attorney comments here “…The people of Quartzsite are showing what needs to be done everywhere in the United States. Remember how the polticians freaked when us commoners called them on the carpet at town hall meetings across the country in 2009? Well, that hasn’t stopped. People are finally waking up to their responsibility to go to those meetings and actually participate, to keep an eye not just on their Congresscritters, but also on their local politicians. And the politicos don’t like it, hence reactions like we see in Quartzsite…”

    Unfortunately, he has not been to these meetings (only saw one-sided PORTIONS carefully edited of a few meetings) so what he says is “hearsay” another surprising term I must use for an attorney. If he had gone to these meetings (and I mean many of them) he would actually see that the majority of the meeting public are quiet, sit in their seats, follow the rules and procedures there and are downright pleased with the goings-on. These are the people involved with the town and its events, are helping it to grow, and are involved with helping the less fortunate. There are only a few to a small group that are dissenters who disrupt meetings, who yell out and use profanity, threatening gestures and are downright rude to the others. You would notice they are the ONLY ones disrupting, the ONLY ones trying to un-incorporate the town, not to improve the Constitution’s Liberties, but to make the area lawless.

    It should be noted that all of the other 6 Council Members were recalled recently by this dissident group and 100% of the 6 were voted by the majority of the people to retain their offices. This is the “will of the people” which is the cornerstone of democracy.

    Please also note that this dissident Mayor is up for Recall in August.

    • You say Democracy I say Republic. I understand why things are so bad it’s because you think our country was formed as a democracy yet the founding fathers formed it as a republic because they new a democracy would kill itself over time. Perfect example of Quartzsite Arizona where Democracy prevails and Republic fails. Let the nation know now that we are a republic and if we sit around and do nothing we will become a full democracy and crumble from the inside out.

      The following is what the founding fathers wrote in the US Constitution and believed:

      Article IV Section 4

      The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.

      Thomas Jefferson said, “A democracy is nothing more than mob rule, where fifty-one percent of the people may take away the rights of the other forty-nine.”
      Thomas Jefferson, March 11, 1790: “The republican is the only form of government which is not eternally at open or secret war with the rights of mankind.”

      Alexander Hamilton, in debate, said: “Real liberty is neither found in despotism or the extremes of democracy, but in moderate government.”

      Alexander Hamilton, in Senate: “It has been observed that a pure democracy, if it were practicable, would be the most perfect government. Experience has proved that no position is more false than this. The ancient democracies, in which the people themselves deliberated, never possessed one feature of good government. Their very character was tyranny: their figure deformity.”

      John Adams, in a letter to John Taylor, wrote: “Remember, democracy never lasts long. It soon wastes, exhausts and murders itself. There never was a democracy yet that did not commit suicide.”

      James Madison said: “…democracies have ever been spectacles of turbulence and contention; have ever been found incompatible with personal security, or the rights of property; and have in general been as short in their lives as they have been violent in their deaths.”

      Reduced to its essence the United States is a federal republic, a federation of states with a republican form of government, i.e., a representative democracy, where the citizens elect their representatives for fixed terms of office.

      The Constitution of the United States, Article IV, § 4 provides: “The United States shall guarantee to every State in this Union a Republican Form of Government….” The requirement that the Constitution contain a provision guaranteeing a republican form of government seems to have been driven by Madison. Thus, it is appropriate to turn to his definition of a republican form of government in The Federalist Papers, no. 39, 250–53 (January 16, 1788). There, he writes that “we may define a republic to be, or at least may bestow that name on, a government which derives all its powers directly or indirectly from the great body of the people; and is administered by persons holding their offices during pleasure, for a limited period, or during good behaviour.”
      A familiar contrast is often made between a republican and a democratic form of government based on the latter’s being a direct wielding of power by the people with unrestricted majority rule, and the former’s being a government by representatives elected by the people with restrictions on the power of the majority. It should be noted that the requirement of restrictions on the power of the majority are not contained in Madison’s definition. The restrictions on the power of the majority are, instead, contained in the Bill of Rights. Thus, whichever definition one adopts, the United Stated has a republican form of government.

      Hello Shanana Rain Golden-Bear, AKA Citizen for Quartzsite, AKA Oh.come.on,

      I am hoping that an old article that you wrote back in 2008 when you first took over the Desert Messenger from Aiken Former appointed Mayor of Quartzsite. What you wrote is actually amazing and really just reminded me of the first time I experienced Quartzsite. What an amazing place. I just think, who would want to hurt these amazing people. They work so hard as vendors, lot owners, waitresses, cashiers, basically every one from owners to janitors. What changed with you? Why so bitter towards those that have been faced with life changing decisions made by the city council who spend days, months, years, trying to destroy ones business, home, way of life. Maybe you have no idea what you are involved with. The harrassment of local vendors, city code violations, fire code violations, citations, arrests, etc. etc. etc. Until so many are in deep fear of leaving their homes, attending city council meetings, questioning the authorities of this town when they know that their rights liberties, and freedoms are being blantenly violated in front of every one. Maybe you should go back to being old you and re-read this Editorial from 12-17-08 written by you, Shanana “Rain” Golden-Bear.
      “Economy is going down hill”…blah, blah, blah… Oh, how the media feeds the fear! Did you know that there’s only two basic emotions? Every emotion stems from either Fear or Love. I choose to feed the Love! How about you?

      I fell in love with Quartzsite in 1987, but back then, I did not know why. It took me many years to return, however, Quartzsite has me now!

      This town is so amazing. Look around you…you will see many elders with years of experience, entrepreneurs on every corner, some large, some Mom & Pop businesses, and then there’s Carl’s Jr. who’s founder began with just a single hot dog cart. Any one of the vendors here could have that same success! We never really know, so let’s support them all and create a welcoming environment.

      From their first visit to Town Hall to get a permit, to dealing with the Fire Dept. and the Health Dept., to helping create a warm friendly town where vendors and visitors will want to return year after year! This is important for the ability of this town to not just to survive, but to thrive!
      It’s so easy to fall into the habit of finding faults and focus in on those. The laws of attraction teach us that whatever we focus on we will attract more of into our lives. So, with this paper, I want to focus on the positive! I urge all readers to also focus on the positive events in your life.
      Gratitude is a powerful gift. When we share our gratitude with others, we will have more to be grateful for. In these challenging times, not just for us as a town, but the whole country, and even worldwide, it is time to be grateful for every little thing! They really do all add up!

      We are so lucky to be living in such a wonderful community, filled with abundance, not only in material possesions, but in the love and friendship of our residents and winter visitors!

      Where else can you drive down the street and folks walking their dog will wave to you and smile?

    Then I will here so state, This is the “will of the [Quartzsite, AZ] people” which is the cornerstone of a Republican democracy”. I happen to believe in the republican form of government.

    Finally, even if Mr. Rhodes of Oathkeepers fame isn’t licensed to be an AZ lawyer he can simply dispense advice to counsel who is an Arizona lawyer and it would be up to That lawyer how to proceed.

    Somehow, “citizen” you have no credibility whatsoever. I seriously doubt Mr. Rhodes would announce on his Oathkeepers website that he is the counsel to Mayor Foster and Ms. Jones if he isn’t even able to practice law in AZ. Get Real!

    For the record here, I am not Shanana Rain Golden-Bear or Oh.come.on.

    Milton WT, I’m glad you calmed down. You are right on one thing. One of the former, especially 2 Quartzsite elections ago could have been ‘rigged’. It was something many of us were looking into since we saw many pages of recalled signatures with other ones’ writing in their addresses, dates, etc. We were concerned that ‘snowbirds’ were gotten to sign not knowing they did the wrong thing by possibly listenening to this minority hurting the majority of townspeople. You are supposed to write the entire line yourself (unless incapacitated). To this day we will never know since you are only allowed so much time to appeal. That time is obviously over, but we are now watching every election since carefully, and so is the County and others.

    Since I am not a lawyer, I cannot definitively say that he cannot advise those he wants to in Arizona. I did not say he cannot practice in AZ. What I said was that he is not licensed to practice in AZ, and won’t be until he is licensed to practice here. That is a fact as of my posting. All you have to do is check with the State Bar of Arizona, I have.

      ok citizen according to the state bar he can’t practice law in AZ. I’ll take your word for it if true that is an actual fact! I am happy to know it and I even gave you a thumbs up.

      The turnout in the recent elections is abysmally low, in the hundreds, even in a town of about 3800 less than 600 or so people turned out to vote! Definitely less than 1000. I looked up the La Paz elections site. If many more people eligible to vote do so in Quartzsite assuming a clean and fair election that is a massive victory for the people.

        Yes, Milton W T, the turnout for that last recall was close to 50%. You may not think so but out of the 3600 residents of Quartzsite, there are only approximately 1325 registered voters (almost a third) on the books, that’s all. So 50% for a turnout to vote is better than most elections in other cities and towns, don’t you think? The majority here is a retirement community with quite a lot of elderly (80+). But, 50% of voter turnout for such a small town? That is a victory, and the will of the people had spoken. Ever since Mayor Foster’s win at the election polls, late May, 2010, and he only won by 17 votes, the other incumbents retained their seats, the La Paz Elections Department has kept and will keep a close eye on the recall petitions and elections here, and we are glad for that. His recall petitions went out exactly 6 months (by law) after his election. Having all of the petition papers analyzed, corrected, disallowed, and accepted for validation takes a long time. So the earliest his recall election could be is next month, August 30, 2011. This is stated here so one can see that if you wish to recall someone, even from the moment of winning an election, that it takes 6 months to petition, and another 6-9 months to actually have the recall election, long time from the original election (over a year overall).

        This may give you a hint of why these things are simply blown up right now here in Quartzsite before his recall election and by him and his very group. Getting “steam” per-se is only using viral media to its best, which they are obviously good at and spend all of their time doing it. If you had a small group, and 4-6 of them are key people, 4-6 people could do great damage sending out edited, cut-up videos, and having interviews by far right and far left entities you can do a lot of damage. If you were able, you would know (being here and knowing) that these animosities go way back to right after this town was incorporated back in 1989. A former (and recalled Mayor) is part of this small group and has been seen with this small group, is one of the leaders of this (tongue-in-cheek) uprising. This all began over 12 years ago now, and whatever they can use, they will to spin a negative view on this quiet, peaceful (yes, it is peaceful everywhere and even at most Town Meetings) town. That leader would want the heat off his back for many reasons and Foster wants the heat off his back now to sway the recall elections votes. If you were here just for the last 1.5 years, you would have seen little rumors grow into artificially-created documental untruths. Every thing they could get away with, they did, not because they were true, but because the Town didn’t have anything to say. If something is not true, why give it credibility? Unfortunately, the untruths have grown and grown and gone ‘viral’. Everyone knows how one small group can change the tide. Add to that the unhappy, being passed up for promotion (and other unhappy states) policepersons, it is still a small group. The unhappy policepersons did a bad thing though. They brought all of their unhappiness to that small group (who would love to jump on it) and TO the Council, which is a political forum. When charges are made, the Council cannot be exposed to any of that until the investigative findings come in. The police did it anyway, and it is noted. I am sure their personnel jackets have more interesting detail, all of the truth will come out. In fact, the findings of those charges will soon come into public view.

        Many do not vote, do not go to Council Meetings, the majority do not even know or less care about what is going on. You can drive down any street, including the Main ones, on any day, or night, and you won’t see any activity (barely at all) for 8 months out of the year. We also have a lot of Hispanics being 1 hour from the MX border, and most of us are sure that their majority are not citizens or they had not answered the 2010 Census. Our demographics state we have 1.4% or so Hispanics, we know and see many more than that by walking around town, interacting with them and seeing the school children. We do have a good amount of Hispanic citizens though as well as other ethnic groups. By the way, most of us ALL get along well and are all mixed in well. There is a way smaller group that is causing all of this ruckus. I’m just giving you the statistics here.

        Fortunately, I do have a job and cannot spend all of my time here. I found this site by following the many viral areas this small dissident group has gotten to or by any of their followers. I am not here for a fight, just to show another perspective. Do I agree with everything the Council has done, no, I do not. But, I cannot see a lynching in the process trying to be carried out when I have seen or researched no grievious acts. Let the independent investigations’ findings and the recall election happen, there lies the truth. The majority of the townspeople do not yell, curse and attack anyone or at Meetings, only that minority does. The majority of townspeople do not have arrest records, they do. Your main characters in this all have many, many arrests and violations and citations, the rest do not. The female in the group said on a video that she does not have anything in court, yes, she does, about 4-6 cases in progress with at least a dozen counts. Some have to do with not having proper vendor permits and no business licenses, including the negative and anti-Quartzsite periodical she has, no business license. License and permits are something we all do and have. The Mayor also has a few cases and several counts going on, others as well have cases going on. If there truly was a real story, the majority of our people would be speaking and acting out, not the minority with personal greed issues and personal axes to grind. AS you said, MIlton W T, you have only seen one side, not all. Off to work…I probably won’t be here much more, I just wanted to spend a few days to see if I could shed any light to any one who fairly would listen, the rest will show in time.

    Ok Mr. Citizen a relatively well thought out post. You defended your position about as well as you could and you had your say and actually it was pretty good. Obviously I don’t agree with everything you said but like yourself I am happy that a majority of voters managed to vote in Quartzsite. I am very gainfully employed as well by the way so please don’t worry about me 🙂

    A few modest points:

    Even if my multimedia expertise is not sufficient, I can rely on friends who work in the television and media realms to determine if said videos are overly edited, “cut up” and whatnot. Very few if any are “cut up” with breaks in the middle, with missing tape, audio, and so on. The pivotal videos; Jone’s famous elbow bending arrest, videos featuring Foster trying to have a handle on the meetings, etc. if edited are not edited enough to bring into question the content of the videos. I would even say that most videos are unedited from beginning to end. The council’s side also has a huge dearth of information telling “their side” of the story. Yes, some interview the media but the tape is unconvincing.

    If the council has done nothing wrong and is clean as you allege, then their overreactions to Ms. Jones speaking and following declaring a state of emergency are simply absurd and lack any real reason. If Ms. Jones had been allowed to have her say there would be no arrest no arrest no video no video no state of emergency. See what I mean?

    The council has been caught on tape lying about said emergency to the media and major players such as Mayor Foster and the reporter Jen Jones. Many more violations of law and human decency have been recorded. They were done by the council, the town manager, and chief gilbert. I have seen much more tape than I care to admit of chief gilbert’s conduct and I can solidly say he is not qualified to be a security guard much less a police officer. gilbert is a political hack and a bully on par with any authoritarian regime, even going after people who put political signs on their own property. I emailed several people who had run ins with gilbert and none of them have good things to say about ol greedy goobery gil.

    I can easily go on, but I want to keep it relatively short. Polticians play politics so what? They all do it. Of course when a corrupt banana republic throws charges on its opponents speaking ill of your political opponents by calling them criminals for being charged by said corrupt officials is such bunk. Such a technique is old hat for authoritarian regimes. It never works it didn’t work for the Soviets. The Russians learned to read between the lines of every Pravda issue and we Americans are such good bs detectors nobody believes anything said in the Desert Messenger, the closest thing that council has to state run media. I even wasted a bit of time trying to analyze the DM’s arguments but fairly easily by the way I found things that contradict the arguments the DM posts and refute them fully.

    Well, the “truth” has been coming out for a while and will continue in the coming days and weeks:

    1) Quartzsite Town Independent Audit was finalized and approved!

    2) CENSURED Mayor Foster to be up for Recall Aug. 30, 2011

    3) As of yesterday, “Town of Quartzsite Releases Investigation Report on Police Chief Gilbert.(Quote): “There is no finding of fault against the Chief for following policies and procedures that were set forth before he was hired. Copies of the report are available in the Quartzsite Public Library and electronically on disk.” (unquote). This 200 page investigative report with all exhibits and findings was done by a completely independent investigation by a Law Firm, Jackson Lewis, hired by Southwest Risk, the Town’s Risk Insurance Firm. The Town of Quartzsite had no say in the selection. See full Press Release:

    Doesn’t it make you wonder why all the hubbub ‘before’ the release of this investigation? Has anyone looked at the records, complaints, and court cases slowly worming their way through the court systems on Mayor Foster, Jennifer (Jade) M Tasker Harris Jones, her husband, John (Jack) L Jones, Michael Roth and others? Why the AZPOST John Stair and the other police complaintants all smiled on the side and urged on the near-riot of the dissidents rather than helping things to cool down? Why would any Mayor allow such rage and disruption instead of ‘egging’ it on, ours did? Our Mayor is one of the founders of an anti-Quartzsite Coalition trying to take the town down? Why in such a peaceful community? Only the dissidents have made the town look bad, nothing is going on here just a small group of people wanting to make a big deal of something totally erroneous. Go back to YouTube, watch QEyeswatching videos, look at 3-8-2011 (http://www.youtube.com/watch?v=sJ1paP2VaW0) in particular where Jade is observing the procedures and she is allowed to speak like anyone else. Look right after her arrest’s meeting, the next one, she is observing the rules again, looks ‘staged’ to me.     The Police Chief has been cleared of any wrong-doing, therefore, should not have been charged in the first place…things do not look good for the small group of dissidents including the ‘sour grapes’ for being looked-over policepersons. More to follow…and not just by bloggers.

      Thank you for your post. We do enjoy hearing from you as often as you like to speak your side. I mentioned you as citizen “of” Quartzsite since I find it hard to believe that you are “for Quartzsite.” Fist I would like to point out that you are extremely confident on our blog about your comments only when a new post from “your side of the story” is posted on the Desert Messenger. As you have noticed we do have the desert messenger advertised on the right side of our blog to show everyone what the story is. We as a group working politically and legally have found through extensive research and well etc. that the Desert Messenger is only publishing one side of the story which makes since because of the funding from the town. Unless you can prove me wrong that no one person from the Desert Messenger is receiving funds for any reason.
      No one doubts that Mayor Foster is up for a recall election. As for censoring him and revoking any authority as a mayor once sworn in is another issue that you will find amusing in the next few weeks. 🙂 Point number 3 you mentioned the “Investigative report.” What you did not mention is that the person conducting the report is from the insurance company that is insuring your town, who can lose just as much as the town can by proving wrong doing, was only there and can only investigate harassment, discrimination, and wrongful termination. Why she commented on any legal wrongdoing performed by a police officer towards a citizen is beyond her duties. Also referring the Mayor of a town as being “anti-the town” is helping you lose credibility with any readers interested in the outcome of Quartzsite’s corruption due to lax, and vague regulations, and laws others know this and want to fix there towns. Do you really think that this many people are interested in being anti-anything just so they can destroy the town they live in. Not many people are all about tearing down there homes and culture for their own satisfaction. What is more likely is one to build their town and culture and lose themselves in “benefits.” Also people don’t just rise up and cause such commotion over the fact that they want to destroy every ones happiness. It is more likely that the ones lost in ‘benefits” have found themselves hurting a majority of the town trying to soak up the “pleasures” or joining them because it is easier, and not realizing that the “others” have been violated so much that they are now doing something about it regardless of the repercussions more known as “retaliation, and harassment.” To be honest with you, when we first began our online conversations I thought I might be able to talk some sense into you or at least help you see the medium traditional founding fathers side that we are coming from but now I have lost all hope. It is obvious to me that no matter what happens you are not going to be able to see any other side than the far end that you are reporting from. I am sorry for you. I hope that one day you can dig your head so far out of the sand that you may one day see the United States and the people of the United States for what we were intended to be. Another thing I would like to point out is that the regulations for the city council, town manager, town employees are so vague and do not cover what repercussions there should for violating operations is similar to the reporting’s of the Desert Messenger.     yes citizen is either THE blogger for the DM or some shill speaking on behalf of the DM. citizen failed to talk about any of my points and repeated pablum in the style of the DM. very unintelligent and unconvincing. also insane people mutter the same old things over and over despite introduction of new evidence. insane people are also frequently in denial especially over new and troubling events.

    I not only compare the DM to Pravda and authoritarian state media, I compare citizen to Baghdad Bob. Yes, the “coalition” of sour grapes and dissidents is a tiny minority, even smaller than the 5 person city council, the town manager, vice mayor, chief gilbert, and the staff which has a classified number so big that we had to close the meetings to the public just to fit in our new staff! Yes, the tv appearances are tiny and only those on the far right and the far left pay any attention to them. The anti-quartzsite media machine is at it again with there “anti-town” media bias. The “Revolutionary Peoples” of the council are pushing back in quartzsite in all directions, north, south, east and west to make sure rioters are subdued and the true five citizens, the Demigods of the Council are to be worshipped properly. A recent announcement only Revolutionary Citizens are allowed into our hall, we simply do not have room to accommodate outsiders and rioters because the Majority must have its place and its way. After new officers with Revolutionary principles are hired to replace the indigent turds who betrayed the Revolution, the town will have such a glorious curfew that even the media will have to sing our praises!
    We will survive the Nazi Blitz comrades! We must fight the lies and disinformation coming from outside our noble town. The Defender of the Revolution, Chief Gilbert, will do all he can to protect the town in its hour of need. Onward!

  9. Everyone complains about the Governmt doing nothing, but in reality it’s us doing nothing. If the Americans of this homeland would make a stand and make a demand for what is right then things would finally change. It’s tiring hearing about what’s wrong with our land without action. Stand up for what you believe in.
